1. Postanowienia ogólne

  1. Niniejszy regulamin określa zasady publikacji materiałów sponsorowanych, artykułów gościnnych i innych treści promocyjnych („Materiały") w serwisie https://di.com.pl („Serwis").
  2. Przesłanie Materiału i/lub opłacenie publikacji oznacza akceptację Regulaminu przez Klienta.
  3. Operatorem Serwisu jest Dziennik Internautów Sp. z o.o., ul. Żenczykowskiego 3/5, 00-707 Warszawa, NIP: PL8992645393.

2. Wymagania dotyczące treści

  1. Materiały muszą być zgodne z prawem, dobrymi obyczajami i zasadami uczciwej konkurencji.
  2. Niedozwolone są treści lub linki promujące lub kierujące do:
    • serwisów oferujących produkty, usługi lub inwestycje nielegalne w Polsce oraz Unii Europejskiej, bądź nieposiadające wymaganych zezwoleń,
    • serwisów oferujących schematy finansowe, nieuregulowane kryptoaktywa, hazard, farmaceutyki, treści medyczne oraz erotyczne bez pełnej zgodności z obowiązującym w kraju Operatora serwisu prawem,
    • stron zawierających złośliwe oprogramowanie, phishing lub treści mogące narazić użytkowników oraz Operatora serwisu na szkody.
  3. Redakcja może odmówić publikacji Materiału lub zażądać zmian bez podania przyczyny.
  4. Klient oświadcza, że posiada wszelkie prawa autorskie do przesłanego materiału, odpowiada za zgodność treści z prawem oraz ponosi pełną odpowiedzialność za jego legalność oraz rzetelność.

3. Zasady dotyczące linków zewnętrznych

  1. Linki mogą być umieszczane wyłącznie do stron działających legalnie, z jawnie wskazanym właścicielem i jawnej tożsamości podmiotu
  2. Niedozwolone jest kierowanie do domen:
    • które zostały przejęte, zablokowane lub zawieszone przez organy ścigania,
    • które znajdują się na listach ostrzeżeń (np. KNF, ESMA, BaFin, FCA)
    • lub które prowadzą działalność powiązaną z wcześniejszymi stronami/domenami uznanymi za nielegalne.
  3. W przypadku ujawnienia powyższych okoliczności po publikacji:
    • Operator serwisu może natychmiastowo usunąć link lub cały Materiał,
    • opłata za publikację Materiału nie podlega zwrotowi
    • w miejscu dotychczasowej publikacji Materiału, Operator serwisu może zamieścić stosowną adnotację o przyczynach usunięcia Materiału
  4. Każda prośba o zmianę linku po publikacji wymaga ponownej weryfikacji i zgody redakcji. Operator serwisu może odmówić wprowadzenia zmian bez podania przyczyny.

4. Zasady techniczne i redakcyjne

  1. Materiały muszą mieć charakter merytoryczny i informacyjny, być zrozumiałe i pisane dla ludzi.
  2. Niedopuszczalne są treści generowane automatycznie, zduplikowane, splagiatowane lub wypełnione słowami kluczowymi bez wartości informacyjnej.
  3. Redakcja może dokonywać korekty językowej, stylistycznej i technicznej bez zmiany sensu wypowiedzi.
  4. Formatowanie, liczba linków, sposób ich oznaczenia (DoFollow/NoFollow) i miejsca publikacji wynikają z aktualnej oferty Serwisu Operatora.

5. Odpowiedzialność

  1. Klient ponosi pełną odpowiedzialność za skutki prawne i wizerunkowe wynikające z publikacji Materiału, w tym linków i informacji zawartych w tekście.
  2. Operator Serwisu nie odpowiada za szkody powstałe w wyniku działania lub zaniechania Klienta, ani za skutki decyzji użytkowników podjętych na podstawie Materiału.
  3. Operator Serwisu zastrzega sobie prawo do usunięcia Materiału, bez zwrotu opłaty wniesionej za publikację Materiału, w przypadku:
    • ujawnienia nieprawdziwych danych, gdy zawierają informacje fałszywe lub wprowadzające w błąd
    • zmian w treści strony docelowej prowadzących do naruszenia prawa lub niniejszego regulaminu,
    • żądania organów państwowych.

6. Treści wrażliwe

  1. W ramach publikacji gościnnych obowiązuje szczególna polityka dotycząca tzw. „treści wrażliwych", które mogą wpływać na reputację, widoczność w wyszukiwarkach oraz zgodność działalności serwisu z przepisami prawa.
  2. Do treści wrażliwych zalicza się w szczególności następujące kategorie:

    a) Treści erotyczne i pokrewne

    Obejmują materiały o charakterze seksualnym, w tym masaże lingam, masaże prostaty, masaże tantryczne, erotyczne, produkty i akcesoria erotyczne, afrodyzjaki, portale towarzyskie lub inne treści o zabarwieniu erotycznym.
    Publikacja możliwa jest wyłącznie dla treści o charakterze edukacyjnym lub informacyjnym, po uzgodnieniu warunków i wcześniejszej akceptacji redakcji.
    Publikacje w tej kategorii wymagają dopłaty +60% i podlegają dodatkowej weryfikacji redakcyjnej.
    Wpisy tego typu publikowane są wyłącznie w wydzielonej sekcji z atrybutem noindex, nofollow.

    b) Kryptowaluty i fintech

    Obejmują treści związane z inwestowaniem w kryptowaluty, tokeny, giełdy kryptowalut, projekty DeFi, fintechy, NFT i podobne.
    Ze względu na wysokie ryzyko inwestycyjne i częste nadużycia, publikacja możliwa jest wyłącznie dla treści o charakterze edukacyjnym lub informacyjnym, po wcześniejszej akceptacji redakcji, z dopłatą +50%.
    Serwis nie publikuje materiałów promujących konkretne projekty inwestycyjne, platformy handlowe lub usługi o nieuregulowanym statusie prawnym.

    b) CBD, suplementy i farmacja

    Dotyczy materiałów dotyczących produktów z konopi (CBD), suplementów diety, preparatów farmaceutycznych, medycyny estetycznej, zabiegów o działaniu terapeutycznym i podobnych.
    Dopuszcza się publikację treści o charakterze edukacyjnym, informacyjnym lub opisowym, z zachowaniem zgodności z prawem farmaceutycznym i przepisami o reklamie leków.
    Publikacje w tej kategorii wymagają dopłaty +35% i podlegają dodatkowej weryfikacji redakcyjnej.

    d) Zakłady sportowe i hazard

    Publikacja treści dotyczących zakładów sportowych jest dopuszczalna wyłącznie dla podmiotów legalnie działających w Polsce, posiadających zezwolenie Ministra Finansów RP.
    Dopuszcza się publikację treści o charakterze edukacyjnym, informacyjnym lub opisowym, z zachowaniem zgodności z polskim prawem.
    Wszystkie treści muszą jasno wskazywać legalność operatora i charakter informacyjny materiału oraz potencjalnych zagrożeniach.
    Publikacje w tej kategorii wymagają dopłaty +40% i podlegają dodatkowej weryfikacji redakcyjnej.
    Publikacje dotyczące gier hazardowych online, kasyn internetowych, automatów, poker roomów i podobnych są całkowicie wykluczone z publikacji w serwisie.

  3. Operator serwisu zastrzega sobie prawo do odmowy publikacji dowolnego materiału, który może zostać uznany za niezgodny z obowiązującymi przepisami, zasadami etyki lub polityką redakcyjną, niezależnie od kategorii treści.
  4. Klient przesyłający materiał do publikacji ponosi pełną odpowiedzialność za jego treść oraz zgodność z prawem, w tym z przepisami dotyczącymi reklamy, ochrony konsumentów i przeciwdziałania praniu pieniędzy.

7. Postanowienia końcowe

  1. Operator zastrzega sobie prawo do zmiany regulaminu. Aktualna wersja obowiązuje od momentu publikacji w Serwisie.
  2. W sprawach nieuregulowanych stosuje się prawo właściwe dla siedziby Operatora, to oznacza, że mają zastosowanie przepisy Kodeksu cywilnego i ustawy o świadczeniu usług drogą elektroniczną.
  3. Wszelkie spory rozstrzygane będą przez sąd właściwy dla siedziby Operatora Serwisu.
  4. Akceptacja Klienta: Poprzez przesłanie Materiału do publikacji lub dokonanie płatności za publikację Materiału Klient potwierdza zapoznanie się i akceptację wszystkich postanowień niniejszego Regulaminu.

1. General Provisions

  1. These Terms and Conditions govern the publication of sponsored materials, guest articles, and other promotional content ("Materials") on the website https://di.com.pl ("Website").
  2. Submission of Materials and/or payment for publication constitutes acceptance of these Terms and Conditions by the Client.
  3. The Website is operated by Dziennik Internautów Sp. z o.o., ul. Żenczykowskiego 3/5, 00-707 Warszawa, NIP: PL8992645393.

2. Content Requirements

  1. Materials must comply with applicable law, good practices, and principles of fair competition.
  2. Content or links promoting or directing to the following are prohibited:
    • websites offering products, services, or investments that are illegal in Poland and the European Union, or that lack required licenses,
    • websites offering financial schemes, unregulated crypto assets, gambling, pharmaceuticals, medical content, or adult content without full compliance with the laws applicable in the Operator's country,
    • pages containing malware, phishing, or content that may expose users and the Website Operator to harm.
  3. The Editorial Team may refuse to publish Materials or request modifications without providing reasons.
  4. The Client represents that they hold all copyright to the submitted material, are responsible for the content's compliance with law, and bear full responsibility for its legality and accuracy.

3. External Link Guidelines

  1. Links may only be placed to websites operating legally, with clearly identified owners and transparent entity identification.
  2. Links to the following domains are prohibited:
    • domains that have been seized, blocked, or suspended by law enforcement agencies,
    • domains listed on warning lists (e.g., KNF - Polish Financial Supervision Authority, ESMA - European Securities and Markets Authority, BaFin - German Federal Financial Supervisory Authority, FCA - UK Financial Conduct Authority)
    • or domains conducting activities associated with previous websites/domains deemed illegal.
  3. If the above circumstances are discovered after publication:
    • the Website Operator may immediately remove the link or the entire Material,
    • the publication fee is non-refundable
    • the Website Operator may place an appropriate notice regarding the reasons for removal in place of the previously published Material
  4. Any request to modify links after publication requires re-verification and editorial approval. The Website Operator may refuse to implement changes without providing reasons.

4. Technical and Editorial Standards

  1. Materials must be substantive and informational in nature, comprehensible, and written for human readers.
  2. Auto-generated, duplicated, plagiarized content, or content stuffed with keywords without informational value is prohibited.
  3. The Editorial Team may perform linguistic, stylistic, and technical corrections without changing the meaning of the content.
  4. Formatting, number of links, link designation method (DoFollow/NoFollow), and publication placement are determined by the Website Operator's current offer.

5. Liability

  1. The Client bears full responsibility for legal and reputational consequences arising from the publication of Materials, including links and information contained in the text.
  2. The Website Operator is not liable for damages resulting from the Client's actions or omissions, nor for consequences of decisions made by users based on the Materials.
  3. The Website Operator reserves the right to remove Materials without refunding the publication fee in the following cases:
    • disclosure of false information when Materials contain false or misleading information
    • changes to the target page content leading to violations of law or these Terms and Conditions,
    • demands from government authorities.

6. Sensitive Content

  1. Guest publications are subject to a special policy regarding "sensitive content," which may affect the website's reputation, search engine visibility, and compliance with legal regulations.
  2. Sensitive content includes, but is not limited to, the following categories:

    a) Adult and Related Content

    Includes materials of a sexual nature, such as lingam massage, prostate massage, tantric massage, erotic massage, adult products and accessories, aphrodisiacs, escort websites, or other content with erotic connotations.
    Publication is permitted only for educational or informational content, subject to terms negotiation and prior editorial approval.
    Publications in this category require a +60% surcharge and are subject to additional editorial review.
    Posts of this type are published exclusively in a separate section with noindex, nofollow attributes.

    b) Cryptocurrency and Fintech

    Includes content related to cryptocurrency investing, tokens, cryptocurrency exchanges, DeFi projects, fintech, NFTs, and similar topics.
    Due to high investment risk and frequent abuse, publication is permitted only for educational or informational content.
    Publications in this category require a +50% surcharge and are subject to additional editorial review.
    The Website does not publish materials promoting specific investment projects, trading platforms, or services with unregulated legal status.

    c) CBD, Supplements, and Pharmaceuticals

    Pertains to materials concerning hemp products (CBD), dietary supplements, pharmaceutical preparations, aesthetic medicine, therapeutic treatments, and similar topics.
    Publication of educational, informational, or descriptive content is permitted, provided compliance with pharmaceutical law and regulations on drug advertising.
    Publications in this category require a +35% surcharge and are subject to additional editorial review.

    d) Sports Betting and Gambling

    Publication of content related to sports betting is permitted only for entities legally operating in Poland and holding a license from the Polish Minister of Finance.
    Publication of educational, informational, or descriptive content is permitted, provided compliance with Polish law.
    All content must clearly indicate the operator's legality, the informational nature of the material, and potential risks.
    Publications in this category require a +40% surcharge and are subject to additional editorial review.
    Publications concerning online gambling, online casinos, slot machines, poker rooms, and similar topics are completely excluded from publication on the Website.

  3. The Website Operator reserves the right to refuse publication of any material that may be deemed inconsistent with applicable regulations, ethical principles, or editorial policy, regardless of content category.
  4. The Client submitting material for publication bears full responsibility for its content and compliance with law, including regulations on advertising, consumer protection, and anti-money laundering.

7. Final Provisions

  1. The Operator reserves the right to amend these Terms and Conditions. The current version becomes effective upon publication on the Website.
  2. Matters not regulated herein shall be governed by the law applicable to the Operator's registered office, which means that the provisions of the Civil Code (Polish: Kodeks cywilny) and the Act on Provision of Electronic Services apply.
  3. All disputes shall be resolved by the court having jurisdiction over the Website Operator's registered office.
  4. Client Acceptance: By submitting Materials for publication or making payment for publication of Materials, the Client confirms that they have read and accept all provisions of these Terms and Conditions.
